ISSUING THE LICENSES FOR WORK OF GEODETIC ORGANIZATIONS

GENERAL INFORMATION

The license for work and geodetic license are issued by the Republic Geodetic Authority, by resolution, based on the Law on State Survey and Cadastre ("Official Gazette RS", No. 72/09, 18/10, 65/13, 15/15, 96/15 , 47/17, 113/17, 27/18, 41/18 and 9/20), hereinafter: the Law, the Law on General Administrative Procedure ("Official Gazette RS", No. 18/2016, 95/18 and 2 /2023), the Rulebook on the License for the Work of Geodetic Organization and the Geodetic License ("Official Gazette RS", No. 33/2010) and the Rulebook on Amendments to the Rulebook on the License for  Work of Geodetic Organization and the Geodetic License ("Official Gazette RS", No. 2/2015), hereinafter:  the Rulebook.

TYPES OF GEODETIC WORKS FOR WHICH THE LICENSE FOR WORK IS ISSUED

A license for work is issued to a geodetic organization for the following geodetic works:

1. preparation of technical documentation and professional supervision over the execution of geodetic works for which the preparation of the main design is prescribed;
2. execution of geodetic works for which the preparation of the main project is foreseen;
3. performing geodetic works in the maintenance of the Real Estate Cadastre and the maintenance of the Utility Cadastre;
4. preparation of geodetic base maps in engineering and technical areas for which the main design is not prepared;
5. development of geodetic demarcation design in the field of urban planning;
6. implementation of geodetic demarcation design in the field of urban planning;
7. cadastral classification, soil fertility evaluation and land consolidation valuation.
   • A legal entity that is a beneficiary of budget funds and a public company can be issued a license to work for the above geodetic works (1-7), which they can perform only for their own needs.
   • A higher education institution that implements a study program in the scientific or professional field of Geodetic Engineering can be issued a work license only for the preparation of technical documentation and professional supervision of the execution of geodetic works for which the preparation of the main design is foreseen.
   • A geodetic organization registered abroad can only perform geodetic works in the Republic of Serbia - performing geodetic works for which the development of the main design is planned, if it has been selected as a contractor at an international bidding procedure, and upon fulfillment of the requirements prescribed by the provisions of the Law.
      

REQUIREMENTS FOR ISSUANCE

A license is issued to a geodetic organization if it:

1. is registered with the competent authority of the Republic of Serbia for the performance of geodetic works;
2. has the legally prescribed number of employees of the geodetic profession with appropriate geodetic licenses or employees of the geodetic profession who are not issued a geodetic license in accordance with the law (see conditions for performing geodetic works)
3. has working premises and appropriate measuring instruments and equipment.

Identification credentials

The Republic Geodetic Authority issues an identification card to a geodetic professional and an agricultural professional employed or engaged in a geodetic organization.

An employee of a geodetic organization whose employment in that geodetic organization has ended is obliged to return his identification card to the Republic Geodetic Authority.

Conditions for performing geodetic works

For the performance of works, the geodetic organization must hire a person who meets the conditions for those works:

1. For the preparation of technical documentation for the execution of geodetic works and professional supervision of the execution of geodetic works, for which the preparation of the main design is foreseen by this law, the geodetic organization must have at least two employees of the geodetic profession, at least one of whom has a first order geodetic license.
2. For the performance of geodetic works for which this law provides for the preparation of the main design, the geodetic organization must have at least five employees of the geodetic profession, at least two of whom have a first order geodetic license.
3. For the development of a geodetic demarcation design in the field of urban planning, the geodetic organization must have at least two employees of the geodetic profession, at least one of whom has a first order geodetic license.
4. For the performance of geodetic works on the creation of geodetic base maps in engineering and technical areas for which the main design is not prepared, the geodetic organization must have at least two employees of the geodetic profession, at least one of whom has a second class geodetic license.
5. In order to carry out geodetic works in the maintenance of the Real Estate Cadastre and the Utility Cadastre and the realization of the geodetic demarcation design in the field of urban planning, the geodetic organization must have at least two employees of the geodetic profession with at least completed secondary geodetic school, passed the state professional exam prescribed for that education and work experience of at least three years with that education.
6. For the performance of cadastral classification, soil fertility evaluation and land consolidation valuation, the geodetic organization must have at least one employee of the agricultural profession with basic academic studies in the scope of at least 240 ECTS points, master academic studies, specialist academic studies, specialist vocational studies, master professional studies, i.e. with basic studies lasting at least four years or specialist studies at the university, passed the state professional exam prescribed for that education and work experience of at least three years in the field of cadastral classification, soil fertility evaluation and land consolidation valuation.
7. Aerial acquisition over the territory of the Republic of Serbia for the purposes of the state survey, the geodetic organization must fulfill the conditions for performing geodetic works for which the preparation of the main design is provided by law, the geodetic organization must have at least five employees of the geodetic profession, of which at least two with geodetic license of the first order and possess the authorization of the Republic Geodetic Authority for aerial acquisition, which is issued by resolution within 15 days from the date of submission of the request.
8. Geodetic works in engineering and technical fields (construction, architecture, mining, energy, agriculture, forestry, mechanical engineering and shipbuilding, etc.), are carried out by the geodetic organization in accordance with the conditions prescribed by the law regulating the planning and construction of facilities, i.e. regulations which regulate the execution of works in a certain engineering-technical field.

The geodetic organization, i.e. the authorized person in the geodetic organization shall submit the following to the Republic Geodetic Authority:

1. request for issuing a license for work on Form ZL-1 (Annex 1).
2. decision on the registration of the geodetic organization in the register of the Serbian Business Registry;
3. completed form EMPLOYEES (Annex 2);
4. proof of professional training for persons in the geodetic profession without a geodetic license and persons in the agricultural profession - original or certified copy;
5. proof of having passed the state professional exam for persons in the geodetic profession, when the request refers to the issuance of a work license for performing geodetic works from Article 17, paragraph 5 of the Law - performing geodetic works in the maintenance of the Real Estate Cadastre and the Utility Cadastre and the implementation of the geodetic demarcation design in the field of urban planning, the geodetic organization must have at least two employees of the geodetic profession with at least completed secondary geodetic school, passed the state professional exam prescribed for that education and work experience of at least three years with that education - original or certified copy;
6. proof of the issued license of the Serbian Chamber of Engineers and proof of passing the state professional exam for persons in the agricultural profession - original or certified copy;
7. certificate of work experience of at least three years in the field of cadastral classification, land fertility evaluation and land consolidation valuation, for persons in the agricultural profession - original or certified copy;
8. employer's certificate proving work experience in the geodetic profession, including positions held, with which professional qualification and time period of performance;
9. printed data from the electronic ID card reader, i.e. a photocopy of the ID card for which it is not possible to print data using the ID card reader, for each employee of the geodetic and agricultural profession;
10. two photographs measuring 30 x 35 mm for each employee of the geodetic and agricultural profession, for the purposes of issuing identification cards;
11. completed form GEODETIC INSTRUMENTS (Annex 3);
12. proof of possession of geodetic instruments (minimum one) with which the geodetic organization provides horizontal and vertical positioning of points in the state reference system - original or certified copy. As proof of the possession of the geodetic instrument, an appropriate document, namely the acquisition of ownership, leasing, rental or a separate statement on the possession of the geodetic instrument, certified with the seal of the geodetic organization and the signature of the responsible person, must be submitted, which must contain data on the type and serial number of that instrument;
13. document on the correctness of geodetic instruments from point 12) herein, which may not be older than two years - original or certified copy;
14. Proof of payment: republic administrative fees and fees for issuing licenses and ID's in accordance with tariff number 1 and tariff number 215lj of the Law on Republic Administrative Fees ("Official Gazette of RS", No. 43/03, 51/03, 61/05, 101/05, 5/09, 54/09, 50/11, 70/11, 55/12, 93/12, 47/13, 65/13, 57/14, 45/15, 83/ 15, 112/15, 50/16, 61/17, 113/17, 3/18, 50/18, 95/18, 38/19, 86/19, 90/19, 98/20, 144/2020, 62/ 2021 and 138/2022).

In addition to the address of the geodetic organization's headquarters, the geodetic organization is obliged to report to the Republic Geodetic Authority the addresses of all other work premises that represent separate places/branches of the geodetic organization, registered in the Serbian Business Registry.

If the geodetic organization intends to perform only the geodetic works referred to in Article 12, point 1) of the Law - preparation of technical documentation and expert supervision of the execution of geodetic works for which the preparation of the main design is foreseen, it shall submit the documents specified in point 2) to 11) together with the request from point 1 herein.
